2. All competitions run by Elato through its social media channels and/or website are either games of skill or games of chance, as stated. All entries will be judged equally using the judging criteria notified (if any).

4. Incomplete, or late entries will be deemed invalid.

12. If any prize remains unclaimed for 2 days after being notified, the prize will be awarded to another entrant. No further correspondence will be entered into.

16. For each draw, valid entries will be collated and drawn at random.
17. Winners will be notified by mobile phone or failing that by email. If any prize is unavailable, Elato, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

Entrants consent to Elato using their names, likeness, image and or voice in the event they are a winner (including photograph, film and or recording) in any media for an unlimited time period without remuneration for the purpose of promoting the promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by Elato.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Elato (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Elato’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Elato) due to any reason beyond the reasonable control of Elato; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.

Elato collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information.
